  1. ZIFFNET(tm) OPERATING RULES

  3. The ZiffNet and the CompuServe Information Service
  4. (together, the "Service") consist of computing and information services
  5. and software, information, and other content provided respectively by
  6. Ziff-Davis Publishing Company ("Ziff-Davis ") and CompuServe
  7. Incorporated ("CompuServe"); (collectively, the "Providers"). In
  8. addition, third parties provide information,software, and other content
  9. (collectively, "Third Party Content") which may be accessed over the
  10. Service. These Operating Rules are provided to make online information
  11. usage and communications a positive and secure experience for members.

  13. Members agree during the online sign up procedure to the terms and
  14. conditions outlined in the Operating Rules.

  16. INTRODUCTION

  18. These Operating Rules are part of the terms of your Service Agreement
  19. with Ziff-Davis and CompuServe, and you are bound by them. Providers
  20. may, individually or collectively, modify these rules at any time by
  21. publishing the modified rule(s) over the Service.

  23. ZIFF-DAVIS COPYRIGHT
  24.  
  25. The entire contents of the Service are copyrighted as a collective work
  26. under the United States Copyright laws. The copying, redistribution, or
  27. publication of any part of the Service is prohibited, except as
  28. expressly provided below.

  30. Each member who places information, software or other content in the
  31. public areas of the Service grants Ziff-Davis the right to edit, copy,
  32. publish, distribute, and translate such information, software or other
  33. content. Subject to this grant, each member who places information,
  34. software or other content on the Service retains any rights member may
  35. have in such information, software or other content.

  37. COPYRIGHTED MATERIAL

  39. Copyrighted material must not be placed on the Service without the
  40. permission of the owner(s) or person(s) they specifically authorize.
  41. Only the owner(s) or such authorized person(s) may upload copyrighted
  42. material to the Service.

  44. Members may download copyrighted material for their own use. Except as
  45. expressly provided by copyright law, copying, redistribution or
  46. publication must be with the express permission of Ziff-Davis and the
  47. owner(s) or such authorized person(s), if other than Ziff-Davis .
  48. Permission must be specified in the document, on the Service, or must be
  49. obtained directly from Ziff-Davis and the owner(s) or such authorized
  50. person(s), if other than Ziff-Davis . In any copying, redistribution, or
  51. publication of copyrighted material, any changes to or deletion of
  52. author attribution or copyright notice are prohibited.

  54. PUBLIC DOMAIN MATERIAL

  56. Any member may upload public domain programs to the Service. Any member
  57. may download public domain programs for their own use or non-
  58. commercially redistribute a public domain program. Member assumes all
  59. risks regarding the determination of whether a program is in the public
  60. domain.

  62. CONTENT & USES OF THE SERVICE

  64. Member agrees not to publish on or over the Service any information,
  65. software or other content which violates or infringes upon the rights of
  66. any others or which would be abusive, profane or offensive to an average
  67. person, or which, without the approval of CompuServe, contains any
  68. advertising or any solicitation to use goods or services. This
  69. paragraph, however, shall not be interpreted to restrict member from
  70. utilizing CompuServe Mail in the conduct of a legitimate business except
  71. that member may not, without the approval of CompuServe, send
  72. unsolicited advertising or promotional material.

  74. Member agrees not to use the facilities and capabilities of the Service
  75. to conduct any business or activity or solicit the performance of any
  76. activity which is prohibited by law or to solicit members to become
  77. members of other competitive information services.

  79. EDITING AND DELETING CONTENT

  81. Ziff-Davis reserves the right in its sole discretion to edit or delete
  82. any information, software or other content appearing on the Service,
  83. regardless of whether it violates the standards for content.
  84.  
  85. SERVICE TERMINATION

  87. Ziff-Davis and CompuServe reserve the right in their sole discretion to
  88. suspend or terminate Service to any member at any time.
  89.  
  90. INDEMNIFICATION
  91.  
  92. Member agrees to indemnify and hold Ziff-Davis and CompuServe harmless
  93. from any claims and expenses, including reasonable attorney's fees,
  94. related to member's violation of the Service Agreement, including these
  95. rules, or any information, software or other content placed in the
  96. public areas of the Service by the member.
  97.  
  98. MEMBERSHIP
  99.  
  100. Multiple members of the same household may share a single User ID
  101. Number. However, only one person is authorized to access the Service at
  102. any given time on one User ID Number.
